UPDATE AS PER DEGREE 219/2025/NĐ-CP

There are 4 types of Work Permits:

In addition to the issuance of a new Work Permit, there are also types of processing Work Permits such as renewal, reissuance and exemption of Work Permits.

  1. Issuance of a new Work Permit
    • Foreign employees who have never held a Work Permit;
    • Foreign employee has a valid Work Permit but is working in the same job position for a different employer.
    • Foreign employee has a valid Work Permit but is working in a different job position for the current employer.
    • Foreign employee whose Work Permit has expired but continue working in the same position;
    • Foreign employee holds a Work Permit issued before April 1, 2016.
  1. Work Permit Renewal:
    • Foreign employees must submit a Work Permit renewal application to the Ministry of Home Affairs or the Department of Home Affairs (Employment Bureau) at least 5 days but no more than 45 days before their current Work Permit expires to continue working legally in Vietnam.
    • A Work Permit can be renewed only once for a maximum period of 2 years.
  1. Reissuance of a Work Permit
    • The Work Permit is still valid but requires changes to the information recorded on it, such as passport number or name.
    • The Work Permit is lost or damaged.
  1. Work Permit Exemption

The duration of a renewed Work Permit 

The validity period of work permits that are renewed shall be the same as that of one of the documents specified in Degree 219/2025/NĐ-CP but not exceed 02 years for each renewal.

Conditions for renewal of Work Permit

– Pursuant to Article 16 of Decree No. 152/2020/NĐ-CP and Decree No. 219/2025/NĐ-CP, the conditions for renewal of a work permit are as follows:– At least 10 days but no more than 45 days before the expiration of the work permit.

– Having the demand for employing a foreign employee approved by the competent authority.

– Documents proving that the foreign employee will continue working for the employer in accordance with the contents of the issued work permit (as stated on the current website).

PROCEDURES FOR RENEWAL OF WORK PERMITS

PROCEDURES FOR RENEWAL OF WORK PERMITS

1. At least 10 days but no more than 45 days before the expiration of the work permit, the employer shall submit an application for the renewal of the work permit in person, by post, via a service provided by an enterprise or individual, or via an authorized representative to the Public Administration Service Center in the province or city where the foreign worker is currently working.

2. The local Public Administration Service Center shall forward the application in accordance with laws on administrative procedures under the single-window and Interlinked single-window mechanisms at the single-window section and National Public Service Portal to the competent authority for renewing work permit.

3. Within 10 working days from the date receiving a complete application for renewal of the work permit, the competent authority shall review and approve the application and renew the work permit for the foreign employee..

In case of refusal, the authority must respond in writing, clearly stating the reasons.

4. For foreign workers as prescribed in points a and m of Clause 1 of Article 2 hereof, after having his/her work permit renewed, the employer and the foreign worker must sign an employment contract in accordance with Vietnamese labor law before the expected date of resumption of employment.

Upon request, the employer must send a copy of the signed employment contract to the competent authority that issued the work permit.

APPLICATION DOSSIER FOR RENEWAL OF WORK PERMITS

1.A written document from the employer reporting and explaining the demand for foreign labor and applying for the renewal of a work permit according to Form No. 03 in the Appendix attached hereto.

2. Medical examination report issued by a qualified medical establishment, except for cases where the medical examination results have been connected and shared on the Information System for management of medical examination and treatment or the national health database. Medical examination reports issued by competent foreign medical establishments may be used if Vietnam and the country or territory issuing such reports are signatory of the same mutual recognition agreements or treaties, and have the validity period not exceeding 12 months from the date of issuance.

3. 02 color photos (size 4 cm x 6 cm, white background, facing forward, head uncovered, and no glasses).

4. Work permit is still valid.

5. Passport is still valid.

6. The document proving the foreign employee’s working form, except for the case specified in regulations in point a of Clause 1 of Article 2 hereof, which is of the following documents:

a) One of the documents specified in points b, d, dd, and e of Clause 6 of Article 18 hereof;

b) A document from the foreign employer on sending the foreign worker to work for a definite time at a commercial presence in the territory of Vietnam for the case prescribed at point b of Clause 1 of Article 2 hereof;

c) A service provision contract signed between Vietnamese and foreign partners for cases specified in point d of Clause 1 of Article 2 hereof.

Name Consistency Requirement

Ensure that your full name on your degree, experience certificate, teaching qualification (PGCE/QTS), criminal record certificate, and medical certificate matches the full name in your current passport. If there are any discrepancies, a legalized name affirmation will be required.

REGULATIONS ON E-TRANSACTIONS FOR WORK PERMIT RENEWAL APPLICATIONS

Online submission

– Employers shall submit applications for issuance, reissuance, or renewal of work permits and confirmations of exemption from work permit requirement for foreign employees online via the National Public Service Portal.

Penalties for working without a Work Permit

If a foreigner is employed in Vietnam without a Work Permit, they will be subject to penalties. Likewise, employers employing foreign workers without a valid Work Permit will also face fines.

For Foreign employees: According to Clause 3, Article 31 of Decree 28/2020/ND-CP, foreign workers without a valid Work Permit will be subject to the following penalties:

3. Fines ranging from VND 15,000,000 to VND 25,000,000 shall be imposed on any foreign worker in Vietnam that commits one of the following violations:

a) Accepting job offers without holding Work Permits or without written confirmations of their exemption from Work Permit requirements as required by law;

b) Using Work Permits or written confirmations of their exemption from Work Permit requirements that have already become null and void.

For Employers: 

According to Clause 4, Article 31 of Decree 28/2020/ND-CP, employers hiring foreign employees without a valid Work Permit will be subject to the following fines:

4. Fines shall be imposed on any employer that employs foreign workers to work in Vietnam without Work Permits or written confirmations of their exemption from Work Permit requirements, or employs foreign workers holding expired Work Permits or written confirmations of exemption from Work Permit requirements already null or void at one of the following rates:

a) Fines ranging from VND 30,000,000 to VND 45,000,000 to be imposed if the violation involves 01 – 10 workers;

b) Fines ranging from VND 45,000,000 to VND 60,000,000 to be imposed if the violation involves 11 – 20 workers;

c) Fines ranging from VND 60,000,000 to VND 75,000,000 to be imposed if the violation involves 21 or more workers.

According to Clause 5 of this Article 31 of Decree 28/2020/ND-CP:

5. Supplemental penalties

Deporting any foreign worker without Work Permits or written confirmations of exemption from Work Permit requirements that commits the violations specified in clause 3 of this Article while working in Vietnam.
